Terms & conditions

§ 1 Scope and contracting party

  1. These terms and conditions apply to all orders you place in the Bunz No.1 online shop.
  2. Your contracting party is Bunz No.1 Tiernahrung Dietmar und Petra Klein GbR, Glemsgaustraße 25, 70499 Stuttgart, Germany (phone +49 711 39120694, email info@bunzno1.de), “we” below.
  3. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).
  4. Deviating terms apply only if we expressly agree to them.

§ 2 Conclusion of the contract

  1. The products shown in the online shop are not a binding offer but an invitation to order.
  2. During checkout you add products to the cart, enter your contact details and choose the fulfilment method (parcel shipping, delivery round or pickup) and the payment method. Before submitting, you see all details again and can correct them. By clicking the order button you place a binding order for the products in the cart.
  3. We confirm receipt of your order by email straight away. With this order confirmation we accept your order, and the contract is concluded.
  4. We store the contract text. You receive the order details with the order confirmation email; you can view and print these terms on this page at any time. Your orders are also shown in your customer account.
  5. The contract language is German.

§ 3 Customer account

  1. You can order without a customer account. With an account you sign in with your email address and a one-time code, see your orders and manage your delivery subscription.
  2. Please keep your details up to date and do not share the sign-in code with others.

§ 4 Prices and delivery costs

  1. All prices are final prices and include statutory VAT.
  2. Parcel shipping and delivery on our round cost extra; pickup in the shop is free. The delivery costs are shown on the Delivery & pickup page and in checkout before you submit your order.

§ 5 Payment

  1. The available payment methods are shown in checkout, for example credit card, PayPal, Apple Pay or Google Pay. The purchase price is due when you order.
  2. For pickup in the shop you also pay online in advance; payment at pickup is not possible. We put your order together once payment has arrived.
  3. Purchase on invoice is available to regular customers we have approved for it. The invoice amount is payable without deduction within 14 days of receiving the goods.
  4. For the delivery subscription only payment methods that allow recurring charges are available. You store the payment method with your first order.

§ 6 Delivery and delivery area

  1. We ship within Germany with DPD. In the Stuttgart area we also deliver with our own drivers on fixed rounds; the places we serve are listed on the Delivery service page. We do not ship frozen meat by parcel: it is only available on the delivery round or for pickup in the shop.
  2. The rounds run every 4 weeks, Tuesday to Friday. Which round serves you follows from your address. We tell you the exact delivery date after receiving your order.
  3. On the round, we hand the goods over at the delivery address or leave them at a place agreed with you.
  4. If an ordered product is unexpectedly unavailable, we inform you without delay and refund any amounts already paid straight away.

§ 7 Pickup in the shop

  1. You can collect your order free of charge in our shop: Glemsgaustraße 25, 70499 Stuttgart-Weilimdorf. Opening hours are on the Contact page.
  2. As soon as your order is ready, you receive a message. Please collect it within 5 opening days.

§ 8 Frozen goods

  1. We only hand over frozen meat frozen, on the delivery round or in the shop. Please bring a cool bag for pickup and put the goods in the freezer straight after handover.
  2. Damage that only arises after handover because the cold chain was interrupted is not a defect of the goods.

§ 9 Delivery subscription

  1. You can also order many products as a delivery subscription. We offer the delivery subscription only within the area of our rounds. You then receive the products automatically every 4 weeks with your round or for pickup, without ordering again each time.
  2. The price shown when you start the subscription applies. If we change the price, we inform you by email at least two weeks before the next charge; until then you can cancel the subscription.
  3. We charge the amount to the stored payment method before each delivery.
  4. The subscription has no minimum term. You can skip single deliveries, pause the subscription or cancel it at any time, in your customer account under “Delivery subscription” or by email or phone. Changes apply to the next delivery that has not been charged yet.
  5. We can cancel the subscription with four weeks’ notice, for example if a product is permanently no longer available.

§ 10 Right of withdrawal

As a consumer you have a right of withdrawal as set out in our withdrawal information. There is no right of withdrawal for goods that spoil quickly, such as fresh and frozen meat.

§ 11 Retention of title

The goods remain our property until paid in full.

§ 12 Liability for defects

  1. The statutory rights for defects apply.
  2. Please tell us about obvious damage as soon as you can. This does not affect your statutory rights.

§ 13 Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
  2. For slightly negligent breach of an essential contractual obligation, meaning an obligation whose fulfilment makes the contract possible in the first place and on which you may rely, our liability is limited to the typical, foreseeable damage. Otherwise liability for slight negligence is excluded.

§ 14 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 15 Final provisions

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer you keep the protection of the mandatory provisions of the country where you habitually reside.
  2. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Stuttgart.
